Terms of Use

1Eligibility

• You must be at least 18 years of age to use Estavik
• You must be a real estate mediator, broker, or property professional to create a business account
• You must provide accurate information when creating your account
• By creating an account, you confirm you are 18 or older and have read and agreed to these terms

2Account and Access

• Your account is identified by your phone number. You are responsible for keeping your account secure
• Do not share your OTP with anyone. Estavik staff will never ask for your OTP
• You are responsible for all activity that occurs under your account
• One person, one account. Creating multiple accounts for the same person is not permitted
• Staff accounts added under a main account are governed by the main account holder's subscription and these terms

3Acceptable Use

You agree to use Estavik only for lawful property mediation activities. You must not:

• Add false, misleading, or fraudulent property listings
• Use the app to facilitate illegal property transactions
• Attempt to access another user's private vault or account data
• Share links or share functionality to deceive customers or other mediators
• Use the AI parser to process or store data belonging to third parties without their consent
• Attempt to reverse-engineer, decompile, or extract the source code of Estavik
• Use automated tools to scrape data from Estavik or estavik.com
• Resell or sublicense access to Estavik to other parties

4Owner Data and Privacy

• You are responsible for obtaining the consent of property owners before adding their contact information to Estavik
• By adding an owner's contact details, you confirm the owner has agreed to you recording their information for mediation purposes
• Estavik stores owner contacts in an encrypted private vault and never shares them publicly
• You must not misrepresent owner availability, price, or property condition in your listings

5Commission Protect

• Commission Protect agreements made through Estavik are timestamped records of mutual understanding between mediators
• These records are not legal contracts enforceable in court, but serve as evidence of an agreed arrangement
• Estavik is not a party to any co-broking agreement between mediators and has no liability for commission disputes

6Subscriptions and Payments

• Paid plans are billed monthly or annually as selected. Prices are shown on estavik.com/pricing.html
• All prices are exclusive of 18% GST, which is added at checkout
• Payments are processed by Razorpay. By subscribing, you agree to Razorpay's terms of service
• Subscriptions renew automatically unless cancelled before the renewal date
• You can cancel anytime from inside the app. Access continues until the end of the current billing period
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified in advance

7Intellectual Property

• The Estavik name, logo, app design, and all content on estavik.com are owned by TANISHKHA
• You may not use our brand assets, name, or logo without written permission
• Property listings and content you add to Estavik remain your property. You grant us a license to store and display this content within the app

8Limitation of Liability

• Estavik is a tool to help you manage your property business. We are not responsible for the outcome of property transactions
• We are not responsible for commission disputes between mediators, even if Commission Protect was used
• Our total liability to you for any claim shall not exceed the subscription amount paid in the preceding 3 months
• We do not guarantee uninterrupted service. We perform maintenance with advance notice where possible

9Termination

• You may delete your account at any time from Settings in the app
• We may suspend or terminate accounts that violate these terms, with or without prior notice depending on severity
• Serious violations (fraud, illegal use, data harvesting) result in immediate termination without refund

10Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of the courts in Kanniyakumari District, Tamil Nadu, India.

11Changes to Terms

We may update these terms. We will notify you of significant changes via in-app notification. Continued use after notification constitutes acceptance.
