Terms of Use
Please read these terms carefully before using the Estavik app or website. By using Estavik, you agree to these terms.

These Terms of Use are a legal agreement between you and TANISHKHA, the company that owns and operates the Estavik application and platform. References to "Estavik", "we", "us", or "our" refer to TANISHKHA. "You" or "User" refers to any individual or business entity that accesses or uses the Estavik platform.
Important: By downloading, installing, or using the Estavik app or website, you confirm that you have read, understood, and agreed to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use Estavik.
1. Acceptance of Terms
By accessing or using the Estavik mobile application, website (estavik.com), or any related services operated by TANISHKHA, you enter into a binding legal agreement with TANISHKHA governed by these Terms of Use.
These terms apply to all users of the platform including free users, paid subscribers, staff members added under a team account, and visitors to the website.
2. Eligibility
- You must be at least 18 years of age to use Estavik
- You must have the legal capacity to enter into a binding contract under applicable Indian law
- You must not be barred from using the service under any applicable law in India or your jurisdiction
- If you are registering on behalf of a business entity, you confirm that you have the authority to bind that entity to these terms
We reserve the right to refuse service to anyone for any reason at any time, particularly where we have reason to believe terms are being violated.
3. Account Registration and Security
- You register using your mobile phone number, verified by OTP. You are responsible for keeping your phone number and device secure.
- You must provide accurate and complete information during registration. Using false information is a violation of these terms.
- Your account is personal and non-transferable. You may not share your account with another person.
- If you suspect unauthorised access to your account, you must notify us immediately at support@estavik.com.
- Device binding: logging into a new device will automatically log out your previous device. This is a security feature to prevent account sharing.
- You are fully responsible for all activity that occurs under your account.
4. Permitted Use
Estavik is designed for use by real estate mediators, brokers, and property professionals for the following legitimate purposes:
- Managing and organising property listings for sale, rent, or lease
- Storing private owner contact information securely in the Private Vault
- Sharing property details with prospective buyers and tenants via share links
- Managing customer and buyer information and follow-ups
- Tracking commissions and business expenses
- Collaborating with partner mediators on shared deals
- Uploading and managing property photographs
- Using AI document review features for preliminary document checks
5. Prohibited Use
You must not use Estavik for any of the following:
- Posting false, misleading, or fraudulent property listings
- Listing properties you do not have the right to market or mediate
- Using the platform to facilitate illegal transactions of any kind
- Attempting to access another user's Private Vault or owner information
- Reverse engineering, decompiling, or attempting to extract the source code of the app
- Using automated tools, bots, or scrapers to access or extract data from the platform
- Creating multiple accounts to circumvent plan limits or abuse the free tier
- Sharing your account credentials with other individuals
- Using the platform to harass, stalk, or harm any individual
- Uploading content that is obscene, defamatory, or violates any applicable law
- Attempting to overload, disrupt, or compromise the security of the platform
- Uploading photos or documents to which you do not hold rights or proper authorisation
Violations of this section may result in immediate account termination without refund.
6. Property Listings and Content
- You are solely responsible for the accuracy and legality of all property listings you create on Estavik.
- You confirm that you have the legal right or authorisation from the property owner to market each property you list.
- Estavik does not verify the accuracy of property details, prices, or ownership claims.
- By uploading photos, you confirm you have the right to use those images and grant Estavik a limited licence to store, compress, watermark, and display them solely for operating the service.
- You retain full ownership of all content you create on Estavik.
- We reserve the right to remove any listing that violates these terms or applicable law, without prior notice.
7. Owner Information and Privacy
The Private Vault feature stores owner information exclusively for your own use. This is a tool for your personal business management — not a legally binding document or a property ownership verification system.
- You are responsible for obtaining owner consent before storing their personal information (name, phone number, address) in the app.
- You must handle owner data in compliance with applicable Indian data protection and privacy laws.
- Estavik stores this data securely and restricts access to you only, as described in our Privacy Policy.
- You must not use owner information stored in Estavik for any purpose other than legitimate property mediation.
- If an owner requests removal of their data, you are responsible for deleting it from your Estavik account.
8. Sharing and Share Links
- Share links generated by Estavik display your contact information and property details to anyone who opens the link.
- You are responsible for deciding which properties to share and with whom.
- Share links never display owner information — this is a platform-level protection and cannot be overridden.
- Link expiry settings are your responsibility. Estavik is not liable for properties shared via links that you did not set to expire.
- You must not use share links to distribute false, misleading, or fraudulent property information.
- The watermark applied to shared photos is a security feature. Attempting to remove or bypass watermarks is a violation of these terms.
9. Commission and Financial Features
The commission tracker and Commission Protect features are internal business management tools only. They do not constitute legally binding contracts between mediators.
- Commission records, split agreements, and expense logs stored in Estavik are for your personal tracking and reference only.
- The Commission Protect feature creates a timestamped in-app record of agreed splits. This record may serve as supporting evidence in a dispute, but it is not a legally binding contract and does not replace formal written agreements.
- TANISHKHA is not a party to any commission agreement between mediators and accepts no liability for commission disputes.
- For legally binding commission agreements, we recommend consulting a qualified legal professional.
10. AI Document Check Disclaimer
The AI Document Check feature is a preliminary screening tool only. It is not legal advice.
- AI Document Check analyses property documents and produces a plain-language summary of potential issues based on pattern recognition.
- The results are not legal advice and do not constitute a legal opinion from a qualified lawyer.
- Estavik does not guarantee the accuracy, completeness, or reliability of AI Document Check results.
- You must not make property purchase, sale, or legal decisions solely based on AI Document Check results.
- Always consult a qualified lawyer or legal professional before entering into any property transaction.
- TANISHKHA accepts no liability for any loss, financial or otherwise, arising from reliance on AI Document Check results.
11. Subscription and Payments
- Paid plans (Basic, Pro, Platinum) are billed monthly or annually as selected at the time of subscription.
- All payments are processed securely by Razorpay. TANISHKHA does not store your payment card details.
- Subscription fees are charged in Indian Rupees (INR) and are inclusive of applicable taxes.
- Plan limits (properties, staff, photos) are enforced automatically. Exceeding a limit requires an upgrade.
- Coupon codes, where valid, are applied at the time of payment and cannot be applied retroactively.
- Prices may change with 30 days' advance notice. Existing subscribers are protected at their current price until their next renewal after the effective date of the change.
- Pay-per-use features (AI Document Check, extra staff seats) are billed separately and added to the next billing cycle or charged immediately depending on the feature.
12. Cancellation and Refunds
- You may cancel your subscription at any time from within the app settings.
- Upon cancellation, your paid plan remains active until the end of the current billing period. You will not be charged again.
- After the billing period ends, your account reverts to the Free plan. Your data is not deleted.
- Refund policy: We offer a 7-day refund on your first payment if you are not satisfied with the service. After 7 days, or for subsequent billing cycles, refunds are not provided except where required by applicable law.
- To request a refund, contact support@estavik.com within 7 days of payment with your registered phone number and payment reference.
- Annual plan refunds within 7 days are refunded in full. After 7 days, no refund is available on annual plans.
13. Intellectual Property
- The Estavik name, logo, app design, user interface, code, and all associated intellectual property are owned by TANISHKHA and protected under applicable Indian and international law.
- You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Estavik platform without written permission from TANISHKHA.
- You retain ownership of all content you create and upload — property listings, photos, customer data, and notes. You grant TANISHKHA a limited, non-exclusive licence to store and process this content solely for the purpose of providing the Estavik service to you.
- The "Powered by Estavik" attribution on share pages is part of our brand identity. Platinum plan users may remove this attribution as part of the white label feature.
14. Limitation of Liability
To the maximum extent permitted by applicable law:
- TANISHKHA is not liable for any loss of business, loss of profits, loss of data, or any indirect or consequential damages arising from your use of Estavik.
- TANISHKHA is not liable for the accuracy of property listings, owner information, or customer data entered by users.
- TANISHKHA is not liable for disputes between mediators, between mediators and property owners, or between mediators and buyers.
- TANISHKHA is not liable for failed SMS deliveries, payment processing failures, or service interruptions caused by third-party providers.
- Our total liability to you for any claim shall not exceed the total subscription fees you paid to us in the three months preceding the claim.
- The app is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of fitness for a particular purpose.
15. Indemnification
You agree to indemnify, defend, and hold harmless TANISHKHA, its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in any way connected with:
- Your use of the Estavik platform in violation of these terms
- Property listings or content you post that is false, misleading, or illegal
- Your violation of any third party's rights, including intellectual property or privacy rights
- Any dispute between you and a property owner, buyer, or partner mediator
16. Termination
- You may delete your account at any time from within the app. All your data will be permanently deleted within 30 days.
- We reserve the right to suspend or terminate your account immediately, without notice or refund, if we determine that you have violated these terms.
- We may also terminate accounts that have been inactive for more than 24 months after providing 30 days' notice.
- Upon termination, your licence to use the app ceases immediately. Sections of these terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Indemnification) will continue to apply.
17. Governing Law and Dispute Resolution
- These Terms of Use are governed by and construed in accordance with the laws of India.
- Any dispute arising from these terms or your use of Estavik shall first be attempted to be resolved through good-faith negotiation between you and TANISHKHA.
- If negotiation fails, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 of India.
- The seat of arbitration shall be Tamil Nadu, India. Proceedings shall be conducted in English.
- Nothing in this section prevents either party from seeking urgent injunctive relief from a competent court.
18. Changes to Terms
We may update these Terms of Use from time to time. When we make material changes, we will notify you through the app at least 14 days before the changes take effect. Continued use of Estavik after the effective date of updated terms constitutes your acceptance of the changes.
If you do not agree to the updated terms, you must stop using Estavik and may delete your account before the changes take effect.
